The following contractual conditions apply for private customers as well as companies, legal persons under public law and special assets under public law.


General

• Unless otherwise indicated, product images serve as examples only and may vary from the delivered products. All details in the catalogue, newsletter and on the website are given without guarantee and are subject to errors.
• The contract is concluded on written acceptance of the order (order confirmation).

• All prices are in Euro.
• Prices are always as posted in our latest newsletter or on our website at the time of the order.

Orders


Palm sale
• Orders can only been made via our website, by e-mail, fax, or telephone.
• Minimum order value Euro 1000,00-

General
• Order confirmation for palm sale orders where required. We reserve the right to decline orders (without offering a reason) for economic reasons. Where a product is sold out, a substitute of equal value will only be given where expressly requested. Cancellations will only be accepted for products not dispatched.

Delivery costs

Palm sale
The Shipping charges are calculated when we post the palms.If you need to know the exact charges prior to shipping, please ask us for a quote. We offer three shipping options to choose from:
1. Big order:container delivery it may take 1-2 weeks.
2. Regular: Airmail. Good average between speed and cost.
3. Express: FedEx. Fastest, but charges may be considerably higher.
If not specified, we will choose the most economical but fastest way of shipping. We will advise. Shipping will be billed at cost. If you have any special shipping requirements or instructions, please list them under "comments" on the order form.

General
• Additional costs such as phytosanitary certificates, phytosanitary inspection, treatments, or similar necessary costs may be added to your bill where applicable and cannot be reimbursed if an order is cancelled or the product is exchanged or returned.

• All goods deliverable from the warehouse are generally dispatched within seven working days.

Right of cancellation

• The right of cancellation does not apply for companies, legal persons under public law, and special assets under public law.

• Cancellations will only be accepted for orders not yet processed. A restocking fee may apply if orders have already been processed when cancelled.

Right of cancellation for palms
• Given the delicate nature of these goods there is no legal right to return palms once delivered. Any defects will be considered under the terms of the conditions as laid out in the section "warranty".

Warranty

Private customers
• Our warranty is offered is accordance with legal provisions.

Business customers, legal persons under public law and special assets under public law
• the warranty period for goods sold by us is limited to one year. Beyond this the warranty is subject to the legal provisions.
• The purchaser must inspect the goods immediately following delivery by the vendor and must advise the vendor immediately and in writing of any defects. Where the purchaser fails to give such notice, it is assumed that the goods are accepted, unless the fault is such that it could not be detected in the inspection. Where such a defect arises later, notification must be made immediately following discovery of the defect. Otherwise it is assumed that the goods are accepted even with knowledge of this defect.

General
• We offer no warranty for defects arising from the (continued) use of the goods purchased.

Damaged or lost shipments

Shipping and importation are at your risk and expense. Costs incurred through import duties, inspection charges, treatments and the like are solely your responsibility. Damage to, or partial loss of shipments must be noted on receipt by the deliverer on the shipping documents. We can file a claim for damaged or lost shipments with the shipping company on your behalf. Compensation for damaged or lost shipments may be given in the form of replacements where applicable.

• Moroccan law applies under exclusion of the UN-purchase law (CISG).
• Where the contractual partner is a business customer, legal person under public law or special asset under public law, our registered office is stipulated as the exclusive place of jurisdiction for all claims arising from this contract. We are also entitled to take legal action against the customer in the court of its own registered office.
• Should any provision of this agreement be wholly or partly invalid or later lose its legal validity, this shall not affect the validity of the remaining provisions.
